The parties agree as follows:

1. The Project: Client is commissioning a ___________________________created by the Artist.

Subject matter is_____________________________________________________________

________________________________________________________________________. The medium will be ____________________________________on _____________________, and the approximate size will be _________________________cm/inches.

The work will be unframed. It will be in the style of the artist, but, as there are variations in the creative process, the client accepts the artwork will be unique and therefore subject to reasonable variation.

2. Copyright: The Artist reserves the common-law copyright to all works commissioned by Client that are created by the Artist, including all reproduction rights and the right to claim statutory copyright. No work may be reproduced by Client without the prior written approval of Artist and may not be sold by the Client.

The Clients ownership of the physical artwork does not transfer ownership of the artwork’s copyright.

3. Credit: The Artist’s name shall be mentioned in any social media posts, publications or reproductions made by the Client, along with artist website information. 

4. Payment Amounts: the fee is based upon the estimated time it will require, size and complexity of the completed work, and the cost of materials. The amount for this commission is ______________.

5. Payment Terms: A non-refundable deposit of fifty percent (50%) of the selling price is required before work commences. Payment in full is due upon receipt of artwork.

In the case that the Client does not wish to continue with the commission from the completion of preliminary stage  (sketch is presented to client): The Client is under no obligation to pay compensation to the Artist.

In the case that the Client wishes to cancel the commission while in progress or upon completion the Artist keeps possession of the piece.

6. The Client will arrange for and pay for the delivery of the artwork.

By signing below, both Client and Artist hereby agree to the terms stated above. Work will commence on receipt of this contract and the first payment installment.
